No one will be prosecuted for the death of a father of 10 killed last July when his car was hit by a Lee County sheriff’s detective as deputies chased the wrong burglary suspects.

Jury Determines That Walmart’s Negligence Caused Serious Injuries To A 57 Year Old Woman
Fort Myers, FL, July 11, 2008- After a four day trial, a Lee County jury returned a verdict in favor of Linda Gail Wright against Walmart Stores, Inc. in the amount of $1,000,000.00. Mrs. Wright claimed that Walmart’s negligence resulted in a fall causing debilitating neck injuries.
Mrs. Wright was represented by local attorneys, Evan Lubell of Berke & Lubell, P.A. and Ty G. Roland of Aloia & Roland, LLP. They presented evidence that on October 30, 2002, Mrs. Wright, previously an avid horse trainer and rider, had entered Walmart in North Fort Myers in search of Halloween candy. Instead, she slipped on a puddle of oil and water that had spilled from rotisserie chickens which were packaged by Walmart in plastic containers. As a result, Mrs. Wright underwent multiple cervical spine surgeries. She now has a permanent titanium cage stabilizing her neck. Mrs. Wright owes more than $123,000.00 in medical bills.
After years of litigation, the jury deliberated and returned its verdict well after 5:00 p.m. on Friday. Throughout the trial, Mrs. Wright’s attorneys highlighted Walmart's failure to follow many of its own policies and procedures in regards to keeping its floors safe and clean for customers. Mr. Lubell said, “We challenged Walmart to explain why critical evidence including a statement Mrs. Wright provided to Walmart were not presented to the jury and asked the jury to take a hard look at Walmart’s actions before and after Mrs. Wright’s fall.”
